Gary Lee and Debarbieris Et Al

Discovery is proceeding. A settlement conference is set before Magistrate Judge Sally Shushan on June 11, 2002. We have already sent to the Court for it's consideration, a memorandum setting forth our position on liability and damages. A Pre-Trial conference is set for July 18, 2002 and the Trial is scheduled for August 5, 2002.

Working Out of Class
Bue Et Al

The Civil Service finally ruled on May 1, 2002. The ruling provided for back pay but no promotions. We are filing our appeal and hope to have the appeals court order promotions.

Alonzo Et Al

Civil Service has decided not to have hearings on this case but will conduct a staff investigation. Once the staff investigates each individuals claim, it will be given to Harry Tervalon, Attorney at Law and Hearing Examiner, appointed by the Civil Service Commission. Each complaint should be contacted by a staff member from Civil Service. You should be prepared to prove that you were working out of class and you have a claim.

Albright Et Al

Though we have filed a notice of appeal, the court may not consider the decision final as it has not yet ruled on the attorney fee portion of the case. There is no briefing schedule filed yet; however, as soon as we receive it we will let everyone know.

Sick Time Case
Michael LaFleur Et Al

The Supreme Court granted the City's Writ of Certiorari on December 7, 2001. Our firm as well as attorney's for FOP and LaFleur have all filed briefs in opposition to the City's Writ application. A hearing date has not yet been set, but we should have a hearing date soon. I suspect it will take about thirty to sixty days following the hearing for the Court to render an decision. The decision could reject the City's argument up holding the ruling of the District Court of Appeal. The court could also reverse the lower Courts and render some modified decision.
