A question was again asked concerning the handling of “informal” inquiries received by ranking officers via email from P.I.B.. These inquiries or investigations should be conducted as instructed, however, in all cases, the supervisor should execute Appendix “A”, Page 1, the NOTICE OF NOPD INTERNAL DISCIPLINARY INVESTIGATION RIGHTS AND RESPONSIBILTIES OF EMPLOYEE UNDER INVESTIGATION & NOTIFICATION TO APPEAR TO RENDER A STATEMENT. Whether the statement taken is a formal statement or merely a verbal accounting which is later paraphrased into a “105”, is irrelevant. The form should be filled out, informing the officer of the investigation (or inquiry) and of the officer’s attendant Police Officer Bill of Rights with regard to the investigation or inquiry. A copy of the form should accompany any other required paperwork to P.I.B.

F.O.P. has sent out an announcement that is of interest to all NOPD officers so I am forwarding their email for all PANO subscribers’ review:

From F.O.P.:
The New Orleans Police Department has requested funds from FEMA for the purchase of radios and bulletproof vests to replace those lost or damaged in the flood waters of Katrina. FEMA is requiring that an affidavit be completed by individual police officers affirming their loss. The department has requested that the Fraternal Order of Police assist them in this process. To that end, FOP Employee Representative (and attorney) Donovan Livaccari has prepared the necessary affidavit forms. The FOP will cover the copying costs of producing an adequate number of affidavit forms, and FOP members Donovan Livaccari, April Overman, and Bobby Gostl (all certified Notaries Public) have volunteered their services to notarize the affidavits.
We will begin the process of collecting the notarized affidavits at Thursday nights FOP meeting, and set up a process, next week, to visit district (and other unit) stations to continue the affidavit process. The FOP is requesting that any officer, whose police radio or bulletproof vest was lost or damaged during Hurricane Katrina, stop by the FOP meeting on Thursday July 13, 2006, between the hours of 6PM and 9PM to complete the required affidavit form.
